By decision of the Federal Court of Original Jurisdiction No. 11 in Civil and Commercial Matters in and for the City of Buenos Aires, through Clerk’s Office No. 22, in the case entitled “COLLATERAL ISSUE No. 1 - PLAINTIFF: CONSUMIDORES LIBRES COOP LTDA DE PROVISIÓN DE SERVICIOS DE ACCIÓN COMUNITARIA, DEFENDANT: AEROLÍNEAS ARGENTINAS S.A., PROVISIONAL REMEDY” (“INCIDENTE Nº 1 - ACTOR: CONSUMIDORES LIBRES COOP LTDA DE PROVISIÓN DE SERVICIOS DE ACCIÓN COMUNITARIA, DEMANDADO: AEROLÍNEAS ARGENTINAS S.A. S/INCIDENTE DE MEDIDA CAUTELAR”) (No. CCF 001583/2017/1), we are writing to inform you that:
1. If you bought any tickets for an international flight during the year 2016 to fly in 2017, it is possible that you have paid a higher Fee for Use of International Airport Terminal (TUAI, for its acronym in Spanish) than the one set for your flight (cf. Decisions No. 168/15 and 101/16 of the Argentine Airport System Regulatory Agency (ORSNA, for its acronym in Spanish)).
2. Consumidores Libres Cooperativa Ltda. De Provisión de Servicios de Acción Comunitaria y Unión de Usuarios y Consumidores has brought the collective proceeding entitled “CONSUMIDORES LIBRES COOP LTDA DE PROVISIÓN DE SERVICIOS DE ACCIÓN COMUNITARIA ET AL VS. AEROLÍNEAS ARGENTINAS S.A., FAST-TRACK PROCEEDINGS” (“CONSUMIDORES LIBRES COOP LTDA DE PROVISIÓN DE SERVICIOS DE ACCIÓN COMUNITARIA Y OTRO C/ AEROLÍNEAS ARGENTINAS S.A. S/SUMARÍSIMO”) (Record No. CCF 001583/2017) to claim the refund of the payment made for TUAI in excess.
3. As set forth under Section 54 of Law 24240 (Consumer Protection Law), you may decide to withdraw from the judicial proceedings referenced in paragraph 2 above, in which case you shall express such decision in the abovementioned record, pending before the Federal Court of Original Jurisdiction No. 11 in Civil and Commercial Matters in and for the City of Buenos Aires, Clerk’s Office No. 22, located at Libertad 731, 7th Floor, City of Buenos Aires.
